The international hue and cry against Vladimir Putin for committing war crimes is an understandable reaction to the horrific brutality that Russia has unleashed on the people of Ukraine. But there are serious holes in the argument that will have to be repaired before President Putin can be brought to justice. For instance, the most insistent calls for Putin’s prosecution are coming from President Joe Biden of the United States. The natural forum for such a trial is the International Criminal Court (ICC), established by international treaty, that came into force in 2002. But the US is not a signatory to it; nor is Russia.
